Hi boys ;) I was down in Rutland yesterday, oh so hot! I wanted to register to win that cute little Pontiac G5 that they're giving away on Z-97. I couldn't find anywhere to register. I went to the dealer and there is no car to peek at. Are the boys at Z having fun with us? I hope I can win a nice lavender colored car. Its my fave color ;) How do I sign up to win? Can't wait to drive away in my new car! :p I know everyone here knows what I shoud do!

From the mean streets and dark alleys around Rutland, we hear that Z 97 does not have the actual car itself, or the terms of the giveaway, or even defined contest rules for that matter. As Bufurd T Justice would say, "Boy, you're in a heep of trouble'... Another one for the legal department to figure out. Next time Z 97 decides to giveaway a car, they should take care of that small minor detail prior to launching what could have been an exciting promotion.. GET THE CAR FIRST !!
 
Wait a sec here...Kracko-are you serious that a radio station is doing a car giveaway and conveniently forgot to have a car to give away? No posted or broadcast contest rules? Thats incredible. The FCC is going to have a field day with this. I've seen some stupid stuff in my time, but this might just top the list.
To further quote Buford T Justice "Bank Robbin is baby s--- compared to what this dude is doin".
 
This one you can put under the "Fire, Aim, Ready" or a "Happen waiting to accident" catagory. Havn't heard much play up of the giveaway or any retractions either of late.. Don;t hold me to the legal fire on this, though I'm sure I'm not far off base either. This stuff is not rocket science.

Does any of this apply to the contest?

"For purposes of Section 73.1216, the term ``contest'' is defined as a scheme in which a prize is offered or awarded, based upon chance, diligence, knowledge or skill, to members of the public. ``Material terms'' include those factors which define the operation of the contest and which affect participation therein. Although the material terms may vary widely depending upon the exact nature of the contest, they will generally include: (1) how to enter or participate; (2) eligibility restrictions; (3) entry deadline dates; (4) whether prizes can be won; (5) when prizes can be won; (6) the extent, nature, and value of the prizes; (7) the basis for valuation of prizes; (8) time and means of selection of winners; and/or (9) tie-breaking procedures.

In general, the time and manner of disclosure of the material terms of a contest are within the licensee's discretion. However, the obligation to disclose the material terms arises at the time that the audience is first told how to enter or participate and continues thereafter. The material terms should be disclosed periodically by announcements broadcast on the station conducting the contest, but need not be enumerated each time an announcement promoting the contest is broadcast. Disclosure of material terms in a reasonable number of announcements is sufficient. In addition to the required broadcast announcements, disclosure of the material terms may be made in a non-broadcast manner. "

So does this mean that they're in the clear until they tell someone how to enter? Have they done so at any time?
 
It does if the station didn't post the complete rules on their website, on the air,sponsor locations or other easily accessible place. Not disclosing the rules of a contest is a violation of 73.1216.

Wow... Dudeman.. Ask your Sales Manager to go out and get the car. Trade it, added value it, throw in a few remotes.. Make it look good to the dealer. Then spend a little time and write up some imaging, send it off to Vanilla or where ever and then schedule the promotion. Instead of wasting time defending yourself and station on this post. All a defensive position does is invite opposition. You should have realized that by now.

It sounds to me that someone is one person here and is talking about this car under two different names.... Are you trying to make someone look bad... Z97, Smith Buick and the Vermont State Fair are giving this car away and everything is very much in shape.... With one the best General Managers in radio at Z97, I don't know how you would expect that everything wasn't in line... Thank you Debbie for all of your hard work. You are turning radio in Rutland around in the right direction....

Wow Happy Harry, you make it sound simple and it is.. I agree with you here. However it appears that this is not the case here. When a promotion, especially a promotion of considerable magnitude like a car giveaway is on the air without all the i's dotted and the t's crossed, and seems to made up as they go along. It kills the reputation of the station, it's people, leaves a sour taste with the sponsors big and small, and there's that legal thing to worry about for the afore mentioned if this appears to be the case here. What kind of car, year of car is it again ?
