WIHS complaint against W285DE

It will be very interesting to see how this pans out. All 3 complaints are from both station's distant/fringe areas... What do you think?

I'm surprised to see one from Miller Place (Long Island). Miller Place, of all places!
 
Looks like a pretty open-and-shut case to me, since the FCC Rules are very clear. If a regular station is losing listeners because of a translator, then the x-lator has to make changes.

Let's see what happens next. I know that this x-lator has caused a big chunk of the WIHS listening area to "disappear". It takes time for people to realize that they have to contact the FCC, since the station cannot solicit responses.

So far, these are all people who have asked "what can we do?" and they were given the FCC contact address, where they could complain.
 
The problem is, at what portion of the WIHS contour are the complaints coming from? If it's outside the protected portion of the contour you're gonna be up the creek without a paddle, no matter the way you interpret it.

The station absolutely can solicit responses. It happens all the time in these situations.

105.1 TOS in Maine is a good example of this. that Low Power FM on 105.1 in Portland ME is just a pain and the *** TOS used to make it to Burlington Vermont, and all of southern ME near portland just fine.
 
In past actions, the FCC has made it clear that "protected" contours do not matter, when members of the Public are affected by a translator station. The translator will lose, because that is how the Rules are written. There is plenty of precedent, thankfully. Based upon that, WIHS has a very good chance of having this problem resolved in the listeners favor. :)
 
I don't get why this translator is so bad. Three complaints? Geez.

The Waterbury translator is causing much more interference to ESPN 97.9 than this one is to WIHS and the FCC isn't complaining about that one.

The FCC doesn't do the complaining. The full-power station receiving interference does the complaining. By the way, CCM+E has done plenty of soliciting when it comes to interference complaints with WUCS, you'd have to ask them why they haven't filed an interference complaint yet.

One complaint is too many complaints... that's just the rules when it comes to primary services and secondary services.
 
That's three complaints *SO FAR*!!

There is no question there will be more. Remember, the general public tends to be very ignorant of technical matters. The first thing they will blame, is their radio. Once they realize it's not the RADIO, they will pick up the phone, or send an e-mail.

The ball is JUST BEGINNING to roll. :)

Everything I've read here and elsewhere, indicates that the FCC Rules are in WIHS' favor.

I feel badly for those listeners who have lost a station they have enjoyed for so many years! That precious little lady out in Long Island really cuts to the core of my heart! She's been listening for DECADES, and suddenly is WITHOUT that radio companion! I pray that the FCC hurries for HER sake!
 
In case anyone missed it posted elsewhere... that translator has applied for, and BEEN GRANTED (on 11/2) permission to change frequency to 104.5 with a different pattern. :) We couldn't be more pleased! :) This is a WIN-WIN for *EVERYONE*!
 
WIHS is now IN THE CLEAR!! :D

The translator has moved to 104.5 sometime in the last few days. Our signal is once again CRYSTAL CLEAR in Orange, CT, where it was once COMPLETELY covered-over! :) It should also be quite listenable in Milford, as well as parts of Stratford, Bridgeport, and Trumbull. :)
