We must still keep in mind that the reapply for license they sent in 2004 has NOT been granted and is still in the consideration stage. They are legal, but can this be a hurdle for the sale or will the FCC consider a new owner to ok the license renew if these problems or problem, I assume, had nothing to do with Mr. Wilhite in '04?

Remember the broadcast license is a federal license issued by the Federal Communications Communication which has full ownership authority over the license. A state court cannot overrule a federal decision. However, the physical assets such as the land, towers, broadcast equipment, etc. CAN be be state court ordered to be sold to the highest bidder.
