We must still keep in mind that the reapply for license they sent in 2004 has NOT been granted and is still in the consideration stage. They are legal, but can this be a hurdle for the sale or will the FCC consider a new owner to ok the license renew if these problems or problem, I assume, had nothing to do with Mr. Wilhite in '04?

The FCC will approve a license transfer that is still in the pending stage under certain rare conditions. Of course this is the exception to the rule and not the norm.

The fact the WELE's license is still in the pending stage could be a hurdle for any license transfer, however, the fact that the Commission has accepted the license transfer application for filing indicates the FCC may look favorably toward renewing the license and approving the transfer. It is ALWAYS in the public interest to keep a licensed station on the air (when possible) rather than allow the station to go dark. And it may be that the FCC attorney representing the buyer has filed a petition on that basis to push the license renewal and transfer underway. Considering Radio Goliath, LLC is owned by a "local", this would score high on the "public interest scale" with the Commission.

Ordinarily the FCC will not approve a license transfer when said license is in the pending renewal stage. However, as stated above, there are rare exceptions to this rule, and we may find Radio Goliath, LLC as the new WELE owner within the next 90-days.
 
A "Petition to Deny" was filed by Black Crow Radio, L.L.C. on Dec. 28, 2009. Informal objections were filed by West End Media Group, Inc., Murray L. Steinberg and Barbara F. Steinberg as well as George and Constance Colby. The Steinberg group (Steinbergs and Colbys) have dropped their objection but Black Crow has not dropped theirs. We all sit and wait and see what the FCC will do. My feeling is this will delay the inevitable. Goliath radio will eventually get the license transferred, because Big John had nothing to do with the Travel Show that seems to have caused all of the problems for WELE.

But, there is STILL something in question with the license renew 6 years ago. It is still pending under Wilhite.

But, the license renew is also still in the accepted for filing mode from '94

The usual FCC procedure in cases such as this will involve an action on the license renewal first before any action is taken on the license transfer request. This means, if the license is renewed, the next step will be to act on the transfer request and the FCC will most likely approve transfer of the license to Goliath Radio, LLC. If, for any reason, the FCC does not renew the license, then, of course, there will be nothing to transfer and the station will go off the air. The point is the license will not be approved for transfer while still in the "Pending" stage as it has been for sometime.
