Will the commission fine theres guys?

This morning at 10:11 am EDT on CBS TV they did a piece on radio free zones, those places where they limit transmissions so radio telescopes can be operated without overloading? Well, as part of the piece they dropped the EAS data bursts into the audio several times. I thought that FCC rules restricted use of the data bursts except for actual alerts. Who gets fined? The network or the individual stations? Seems that if they fine stations for carrying the nip slip from the Superbowl and Janet Jackson a few years back they should also fine them for this. What say you?
 
I'm confused--do you mean the news story was talking about the use of EAS & ran the "duck farts?"
I'm not getting the connection between the radio quiet zone (probably the installation at Green Banks, WV) & EAS.

Or was the story interrupted by the EAS traffic? If its the later, may be the local affiliate messing up.
 
My guess is no one will be fined as long as no actual alerts were triggered.
 
Is this a violation of Section 11.45 of FCC Rules?

"No person may transmit or cause to transmit the EAS codes or Attention Signal, or a recording or simulation thereof, in any circumstances other than in an actual National, State, or Local Area emergency or authorized test of the EAS."

This rule also refers Broadcast station licensees to Section 73.1217 , "Broadcast hoaxes."
 
If you're talking about the tones when they were showing the "Radio Cop's" truck, those weren't EAS tones. They were probably data bursts from something he was tracking down, like maybe a utility meter transponder.
Those guys do some very important work, tracking down interference from nearly every conceivable type of device, from cell phones, to power lines. They can even "see" when you have a digital camera in your pocket.

The great news for the TV boys is they generally are at the "end-of-the-line" on the EAS daisychain in most places. They rarely bother to volinteer to be written any other way into state plans. As with many things goverment, doing the minimal is usually always the best policy. Those that volinteer for being LP1 or PL2, State Primaries, etc. get all the grief and potential to get fined. They best thing is to sit on your hands as much as possible with this goofy EAS deal.
