WINF (101.9) now has interference caused WNKO (101.7)

It has been reported on this thread and others that WINF-LP has had a much larger coverage area then they are licensed for...

Found this in the NABCO filing for August 1:


Moreover, while DCD is focusing some attention on its governance
documentation, where is the attention to rectifying its operation of WINF-LP in blatant
contradiction to its license, as documented in the North American Response? CDBS records
show no requests for operation at reduced power or modification of license of WINF-LP, nor
explanation as to how Mr. Litton could have certified proper construction in DCD‟s license to
cover application when the LPFM antenna was placed at nearly twice the authorized height.
 
It looks like this was precipitated by WINF filing for a 2nd adjacent waiver to move to 99.3. The FCC issued a "show cause" order to NABCO to demonstrate why the WINF application should not be approved. This prompts NABCO to dig up as much dirt as they can to get the application denied. NABCO filed a response to the show cause order that isn't viewable online, but apparently brings up issues regarding WINF not building their facility to the parameters on the license, and the licensee not meeting the legal requirements to hold the license. DCDC sees the response, goes "oh crap, we just got busted," fixes their non-profit registration with the Ohio Secretary of State, and files the Form 316 to change the board to resolve the cross-ownership issues. NABCO now has them well on their radar, and files an objection to the transfer of control demanding more documentation in the application of when the board was changed, and reiterating the issues brought up earlier in response to the show cause order.

I see a fine or license cancellation coming for WINF if everything in this objection is true.

Thanks for the update. When the Delaware County Development Company first applied to move to 99.3, NABCO's comment was, "We doubt the
FCC would ever grant their application to move to 99.3 FM." They also said they weren't sure if they were going to file an objection to that
FCC application. With Delaware County being one of the fastest growing counties in the US over the past ten years or so, one would expect
NABCO to file an objection to Delaware County Development Company application to move WINF-LP to 99.3.
Didn't find any objections filled by NABCO on WINF's application to move to 99.3 on the FCC website. Nevertheless, it was apparent this posted objection was precipitated by WINF filing for 99.3. Sure wished the FCC posted the "show cause" order by NABCO.

If WINF-LP were to lose it's license, would WUCO and WXVG also lose their license? Mr. Litton also owns and operates those stations.

BTW,WUCO is airing announcements to the effect they are going to air the Delaware County Fair Harness Racing for the entire week of September.

that question is difficult, but it seems relatively clear what seems to have happened here.

Mr Litton does seem to have more than a "passing interest" in DCDC, and ICS Communications, and assuming that the other Litton on the board is somehow related, that does create warm and fuzzies in my mind for them.

Also, as a broadcaster and licensee of commercial stations he is assumed to know the rules, and in a very simplified opinion only, he could be close to "lack of candor" issues, which the FCC tends to take rather seriously. I think the studios for the LPFM, and at least one commercial were co-located, even if that was a "favor", it doesn't seems like a real good one of either party!

I was driving along 161 last Thursday afternoon and they were coming in *very* well just west of 71; so well, in fact, that there was hardly any slop from WNKO. There hardly is in New Albany, either, odd because it's their city of license. I hear more slop on 101.9 in Zanesville than I do anywhere in Columbus or New Albany. Is 101.7 still directional? I never found any proof that they used to be but it's always been odd to me how much stronger they are way east of Columbus even with the tower moved.
 
The transmitter is on the outskirts of Johnstown so that both Newark and New Albany will get a full grade signal.I haven't seen the new signal pattern on radio locator to figure whether or not it's still directional.
 
On the Northside of Columbus I get "101.9" way better than a LPFM at 59 watts should come in down this way! If they are truely 'running it right' I wish I owned that signal... does amazing things for only 59 watts at 100 ft.

I am surprised the owners of the Translator in Marion @ 99.3 are not throwing in their two cents.. If WINF moves to 99.3 and keeps putting out as great as a signal as they do now (reaching Columbus) clearly they would cause interference to the 99.3 Translator in Marion OH.
 
I knew when 98.9 came on the air in Columbus Ohio Weslyn had a low power radio station on 98.7 which they kept on after 98.9 signed on. So Winf might just stay where they are. It might cause interference with WNKO but Wnko will still be able to come in once outside the Delaware city limits.

Yea - I dont think OWU cares much though.. everytime i've been thru Delaware (which I admit isn't often) i've heard either static or dead air on OWU's station at 98.7.
 
99.3 in marion is a translator for WCVO 104.9 the river. Maybe WINF will work out an idea and swap frequencies with Wcvo and have the Marion translator on 101.9 and put WINF on 99.3.

Not possible -- Already a translator on 101.9 in Marion.
 
Both are LPFM stations and under those rules they are far enough apart to not interfere with each other, WINF-LP was on the air 2 years before the Marion translator for WEEC in Springfield came on the air. and to be hones i have been up there and they really dont over lap much at all.

I am amazed how well WINF-LP comes in in Columbus, i live on the east side of Reynoldsburg in Licking County and untill WNKO upgraded i could listen to WINF-LP easily in the car.
 
I used to get a decent signal of that Station too till the WNKO upgrade. I thin the station must be directional like WNCI is to protect the WEEC translator.
