Access.1 Communications, owners of Channel 40 as well as several radio stations, will be going into receivership:

Lender Guggenheim Corporate Funding received permission from New York State Supreme Court Judge Judy Kornriech for the move. Guggenheim and Access.1 had been trying for some time to work out a deal that would make it possible for Access.1 to pay its debt and get into positive numbers but it never happened.
