WNSR vs. Cumulus & ABC/ESPN

It is rolling around town that WNSR has won a big decision in their case with Cumulus and ABC/ESPN. The case will be heard in Nashville and not in New York or Washington. The idea is that this is a big advantage for WNSR because the case will be heard in their backyard and not in Cumulus or ABC/ESPN's backyard.

Has anyone else heard anything about this? Anyone from WNSR care to talk or Cumulus for that matter?
 
A Nashville Federal District Court judge this week ruled that independently owned WNSR can go forward with a lawsuit that charges ABC-owned ESPN Radio and Cumulus with conspiracy to move the sports network's programming from WNSR to crosstown Cumulus Sports Talker WNFN-FM (The Fan). Federal Judge Todd Campbell also refused a request by both defendants to move the suit to New York, ruling it will be tried in federal court in Nashville. Attorneys for WNSR say the move of ESPN's programming to The Fan is a violation of antitrust laws and are seeking punitive damages, attorney fees and the recouping of potential revenues that WNSR GM Todd Campbell said "could be losses in the millions of dollars." Johnson also called the court's ruling "a very welcomed decision in the battle between a small, independent local station and two media giants." A trial date has been set for August 2006.
 
Could there be another one on the horizon?

Cumulus has done it again. They have taken Paul Harvey away from WLAC, and ABC news. Why do they think they can get away with this sort of thing. They keep promoting Paul Harvey coming soon. Any guesses hoe soon the law suit from WLAC will be coming naming ABC and Cumulus?

This is an entirely different animal. WLAC (and about 100 other Clear Channel talk stations, for that matter) is giving up ABC News, and in turn, Paul Harvey, in favor of Fox News Radio. It just so happens that Cumulus was the first to pounce on the newly-free commodity.

Now, my question is: What will 104.5 do for national news now? With WLAC taking Fox News, does that mean 104.5 will have to give it up? I'm not sure, because 104.5 uses the 1 minute version, WLAC will use the 5 minute version. If they do give it up, do they find a new national news network (CNN?) or will they just air the top-hour sports report from Fox Sports Radio in overnights?<P ID="signature">______________

In the past, exclusivity has not been purchased in this market for Fox news radio. It seems I've read almost everything there is to read about this new five-year deal with CC's newstalk stations except whether or not the deal includes exclusivity. We'll just have to see for ourselves come Aug. 15.

What I would like to see 104.5 do for news one way or the other, since 99.7 dropped CBS to pick up ABC, is to make a deal with Westwood One for CBS News and CBS Sports programming. Now that would be cool. They could even play on their relationship to channel 5 locally, since 5 is the home of CBS TV.<P ID="edit"><FONT class="small">Edited by jetfli on 07/31/05 04:42 PM.</FONT></P>

August 2006?? Cumulus may have already moved on to the next "format of the month" by then!

I didn't know that 104.5 used Fox News, but doesn't 650 WSM also use Fox currently? What will THEY do now?

That would also be a good signal for Monday night football and maybe KDF can take it when the Predators play.

Part of the problem for anyone picking up CBS radio is the spot clearance issue.
2 minutes an hour, 168 hours a week. If you run newscast intact ( the way they do in smaller markets) no problem; however if you use it just for overnights or when you don't have local news, you have to make good the spots you don't air live. ABC is less ( a five minute newscat has 90 seconds of spots) and the new 5 minute Fox news only has 1 minute.

Trial is NEXT year. Why have't we seen in the trades that ABC lost the first round?

Cumulus and ABC requested and recieved a ruling for the case move from local Court to Federal Court and the Judge apparently denied the Cumulus and ABC motion to move the trial to New York.

Violation of the Communications Act? Extortion? All alleged in the suit.
