WVMC -- what we know for sure

I've been following the story of WVMC (1360 AM, Mt. Carmel), specifically, how its license got turned in and canceled, and have the following info to share:

The station IS broadcasting, according to a friend of mine who drove up there to check out the situation for himself. Not sure where it's being broadcast from, although I'm sure we'll get that info soon enough. It's also being simulcast on 99.1 FM, W256AZ, which is licensed to Russ Withers.

Programming is the "America's Best Music" format, and I'm told the audio quality is not good on FM, like the AM signal is being directly retransmitted or something like that. They have one liner that runs at every break, plus the legal ID. That's it.

My understanding -- and someone, please correct me if I'm wrong here -- is that Russ Withers had an agreement in place with Wabash to run the station, and I think there was also an agreement for him to buy it, but then the license got sent back by Marty Hensley.

I'm still trying to untangle all the connections that tie in to this one, so if anyone can clarify anything, I'd greatly appreciate it.
 
What we know for sure is the last ownership filing for Wabash Communications shows Scott Allen the President of WVMC. No filing for 2006, 2008, or 2010. John Rine is listed as one of the owners. He is Williams boss at the law firm reportedly.

Wabash Communications sold the station to Wabash Broadcasting in 2006, along with the land.

The Illinois Secretary of State can be queried for online status of a Corporation. Wabash Communications was dissolved and Wabash Broadcasting was dissolved by Illinois in 2007.

WVMC went off many times in 2008. Their studio was sold at a Sheriff's Sale and is now apartments. No studio since January 24, 2009.

Withers bought the land and started a rebuild after the license was returned in April 2010. Go to the Wabash County Courthouse and look. The previous owners of the land, tower and transmitter for WVMC? Wabash broadcasting in 2006, First Robinson Savings Bank in 2009. Withers didn't own it until 2010, April.


WCJT LP has been off since 2004. (WNIN HD remember?) WPDQ-LP has been off since Jan 2009.Why haven't they notified they are silent?

Can you own a LPFM along with a TV and AM? Then why is Williams running "Mount Carmel Public Broadcasting, Inc?" Secretary of State says it doesn't exist. FCC Thinks Williams daughter is the President.
 
WVMC filed a request for second extension. The wording in the request is odd and I have to admit I am wondering what is going on.

SINCE THE FILING OF OUR MOST RECENT REQUEST FOR EXTENSION, THE FCC CANCELED THE WVMC(AM) LICENSE. WABASH COMMUNICATIONS, INC. FILED A REQUEST FOR A SPECIAL TEMPORARY AUTHORITY TO KEEP WVMC ON THE AIR PENDING RESOLUTION OF A TIMELY PETITION FOR RECONSIDERATION (WHICH WAS FILED ON MAY 19, 2010). THE FCC AUDIO DIVISION GRANTED THE STA, FILE NO. BLSTA-20100514AGJ. HOWEVER, THE PARTIES CAN'T CONSUMMATE THEIR ASSET PURCHASE AGREEMENT GIVEN THE CURRENT UNCERTAINTY OVER THE WVMC LICENSE. Is it uncertain what will happen?

Here is an even odder portion of one exhibit (Some librarian can tell me if odder is in the dictionary.) :

WE NOTE THAT THE COMMISSION REVERSED ITSELF YESTERDAY (JUNE 3, 2010) AND DENIED OUR FIRST REQUEST TO EXTEND THE TIME FOR CLOSING; Staff denied the Consummation?

NO EXPLANATION WAS AVAILABLE ON THE FCC WEB SITE FOR THIS ACTION. THE PARTIES HEREBY PRESERVE THEIR RIGHT TO APPEAL THAT RULING. ???

ASSIGNOR WABASH COMMUNICATIONS, INC. AND THE ASSIGNEE, W. RUSSELL WITHERS, JR., SEEK TO PRESERVE THEIR RIGHT TO CONSUMMATE THEIR ASSET PURCHASE AGREEMENT UPON THE REINSTATEMENT OF THE WVMC LICENSE. THEREFORE, THE PUBLIC INTEREST, CONVENIENCE AND NECESSITY WOULD BE WELL SERVED BY A GRANT OF THIS REQUEST....

and is this station really even worth all this trouble? when was the last time it was programmed in such a way as to attract any listeners? I seem to recall in the mid 90's Lange couldn't even GIVE it away to Wabash Valley College, of maybe he just says that.
 
The only chance is with an FM station to "rebroadcast" WVMC on. Withers is actually doing this without authority to do so.

The people of mount Carmel who have lost money through investments in WVMC and employees who have had tax money taken are the ones who have lost on this.
