Folks, in a thread I started on 7.24.14 called ROY HENDERSON AND PUBLIC INFORMATION FILES, I stated the following: "I've got a question for all you radio experts. Today, I perused the FCC databases and the internet looking for the locations of Roy Henderson's radio stations KROY 99.7 Palacios and KEMA 94.5 Three Rivers. Of course, the FCC lists the physical tower location, but not the studio. When I called the number listed for the stations in the FCC database, I got connected to Michigan. I said I wanted to look at the public inspection files for KROY and KEMA and asked for the physical location of the records. The lady put me on hold for a few minutes, then hung up. I called back, and got put on hold again. When she finally returned, she instructed me to go to the public library in Three Rivers, and use their internet to access FCC records online."

I have just learned that less than three hours after I made my request, Roy Henderson filed a NOTICE OF SUSPENSION/REQUEST FOR SILENT OPERATION for 94.5 Three Rivers, Texas. The FCC form, which states that willful false statements on it are punishable by fine and/or imprisonment, asks for permission for the station to be silent because "DURING THE NIGHT OF JULY 23, 2014 THIEVES BROKE INTO THE KEMA TRANSMITTER BUILDING. COPPER ITEMS WERE TAKEN AND THE TRANSMITTER WAS DAMAGED. BROADCASTING WILL BE RESUMED WHEN THE DAMAGE IS REPAIRED."

This afternoon, I spoke with a number of folks in Three Rivers. Nobody has heard this station on the air in years. I also talked to a lady at the county constable's office. They don't have any police report concerning these allegations. A search of Google maps of the coordinates where the tower is supposed to be shows an empty field.

A decade ago, Roy Henderson made a $20,000 "voluntary contribution" to the U.S. Treasury to resolve claims of misrepresentation and lack of candor concerning paperwork he filed with the FCC. See http://www.radioworld.com/article/wtcu-calls-license-revoked/9712

I ask again: Why does the FCC allow Mr. Henderson to treat radio stations like pawns on a chessboard? And in this radio game, why do they let him get away with lies and other dishonesty?
 
I definitely find it annoying when company's do things like this. Especially when others go to such lengths to adhere to the letter of the law, its really not that hard to just fallow the rules.

This is further fallout as a result of 93QClassic.com misdeeds that continue to be prosecuted.
I have learned that KEMA is now ready to return to the air but has since discovered its 3-1/8" feed line and antenna is riddled with bullet holes. When will this crime and unnecessary expense ever end?
 
I didn't put you into this, Joe. You did that to yourself. If you'll look closely on the revocation, the petitioner is "Far Eastern Telecasters". That'd be you, Joe, because Roy Henderson certainly didn't file anything like this against himself. Withdrawn or not, this is the direct result of your prior actions. The only thing I, and several others around here, tried to do was to get you to listen to reasoning and to not post all of this stuff on a public forum such as this.

I've never dealt with a STA revoked...however, since the Commish has revoked the one for KEMA, and as I understand the rules, it would have 10 days to get back on the air or notify the FCC as to why it is still off...then up to 30 days before having to file for another silent STA..Of course a petition for reconsideration can be filed as well...I found it interesting the STA was revoked but no letter was sent...
As for 'Far Eastern Telecasters', there are two..one in Texas who has no broadcast licenses and one in Michigan which is a licensee for several stations.
 
If KEMA were to return to the air soon, who wants to bet on a format? I suspect I will be able to pick it up at my location in SA (especially during tropo).
 
Given the location of KEMA, country. Given your location in town, that's going to be a little stretch for you to pick up KEMA with any consistency. Whenever that new 94-7 translator signs on, that will cause problems for me trying to pick up KEMA on the south side.

Pardon my ignorance on the matter, but I can't learn without asking the question.

Henderson can refile for another STA, even though this one has been revoked? I get the whole reconsideration petition option, but how is it possible to refile for the same STA in 30 days, if KEMA is still off the air, when this attempt for silent authorization has now been revoked? Seems more logical that when you're denied like this, it would become a matter of either get to broadcasting as you are authorized to do, or turn in the license.
 
I have not seen the reason why the FCC revoked the STA.....IF KEMA has other issues (like shot up line) not claimed in the original STA, then they can file for another STA...A petition for reconsideration would be more likely if the station claims it still has problems due to the reasons stated in the earlier STA request.

They're actually moving it to 94.5. I forgot about that thing. At least it won't cause problems with KAMX... But now they have to worry about KEMA.
 
As for 'Far Eastern Telecasters', there are two..one in Texas who has no broadcast licenses and one in Michigan which is a licensee for several stations.

The apparent purpose of the Far Eastern Telecasters in Texas is to impersonate the Far Eastern Telecasters in Michigan, and in so doing, file for certain actions regarding station licenses held my the latter, with the intend of convincing the Commission that they are empowered to do so. This is commonly known as fraud, and since a Federal agency is involved, this makes it a Federal crime subjecting the perpetrator to fines and imprisonment.
 
According to Michigan officials, no corporation, partnership, or DBA business registration has ever been filed in that state to conduct business under the name Far Eastern Telecasters. Additionally, the Internal Revenue has no record of a Tax ID being assigned to such a company. The Far Eastern Telecasters of Michigan is a fiction; it doesn't legally exist. Prior to 2014, the only evidence of anyone using said name was a 1986 DBA filing with the Clerk of Harris County, Texas. The DBA expired in 1996, with the name reverting back to the public domain for anyone to claim and register. Thus, the new Texas Far Eastern Telecasters is legally registered and incorporated as a nonprofit entity, with tax Tax ID numbers issued by both the State of Texas and the Internal Revenue Service. It's not fraud for a legally registered company to claim adverse possession of land or assets that were abandoned by a defunct company that never had any real legal existence.

There are numerous legal scholars who have written pieces advocating adverse possession of spectrum that is abandoned by its licensees. I won't cite them here. Look at the facts: A non existent entity called Far Eastern Telecasters somehow managed to get the FCC to grant two TV stations to a city of license (Clear Lake) that also has no legal existence (It's a suburb of Houston). The owner of this non existent entity allowed two LPTV stations to sit dark for years, and even committed perjury in 2011 after the FCC temporarily revoked the licenses, swearing to the FCC they were in fact on the air. Then, look at what the owner did when, in fact, the stations were finally on the air. He surrenders them to the FCC. More evidence of abandonment, justifying adverse possession.

Folks, the newbies won't remember, but some of you will recall how in 2013 I journeyed to Michigan and did everything possible to talk to the owner of the nonexistent Far Eastern Telecasters. Joe, how is KEMA non-existent? I recall you stating that you had returned the station to the air by your own accord, and not exactly broadcasting from the metropolis of Three Rivers, Texas. If you actually did so, what happened to it?

You know, soap operas died off for a reason. It's the same thing that's been going on here for months now. Threats being thrown around, "different" posters attacking Joe, or attacking Roy Henderson, or people who mysteriously find our little slice of heaven to air grievances about the same subject that's been beaten to an absolute pulp.

For the love of God, if you all are going to do something about it then do it. All this talk, and absolutely no action. I swear, I really am thinking we're watching a puppet show, and fellow posters, it our strings that are getting pulled.

But, on the license for KVDO, it DOES exist. And that's the only thing that mattered.

Yes, Joe, you could certainly apply for Far Eastern Telecasters. Which you did. But why? I stated why in my post to you above, and stand by that. You applied for the same name in order to fool the FCC (also referred to as fraud) that you were indeed the "real" Far Eastern Telecasters, request a change of address to Houston, and begin manipulating his property.

All of this is in the "public file" of KVDO-LP that you apparently maintain. Now, how you could maintain a public file for a television station you don't own is beyond me, but then again nothing really surprises me with you anymore, Pearle. This nonsense has gone beyond bizarre.

What you misunderstand is that, in law, "fraud" is deliberate deception to secure unfair or unlawful gain. Fool the FCC? Not. I made sure they knew everything going on.

What you seem to have missed is that from day one I was in constant contact with officials running the FCC's Video Division. Hossein Hashemzadeh, deputy division chief, is the man who in 2013 originally advised me that the KVDO and KJIB licenses should have been cancelled, but since they were still active I could put them on the air with the consent of the licensee. After I secured verbal consent from the licensee's attorney, the same FCC official advised that our church would not be eligible to apply for an LPFM license since we now had an interest in operating and programming two LPTV stations. After the LPTV station was operational for several months, the licensee attempted to reneg on the agreement. On the advice of an attorney, I filed an affidavit of adverse possession along with an application for involuntary transfer of the license based on mental incompetence of the licensee. I was also in regular contact with the FCC Video Division's staff attorney about what was going on.

Do the math: No deliberate deception equals no fraud.
