Missing stations

FCC law is clear. You can't take a license back like a bank repos a car or forecloses on a house. The only way the FCC will transfer it back is if Lopez files to transfer. Contracts and agreements are for enforcement in civil court, which can award damages. But a court cannot transfer a license.
What it depends on is the contract for the sale of the station and how it is written.

I have removed two posts by ContinuousWave due to their content and the possibility that this website could be dragged into the potential legal action.
Content that belongs in the courts does not belong here.

I do not know what the judgment in their case says because it's sealed.
My question was more of an tongue in cheek comment. I truly don't care what happens to those insignificant translators.

The purpose of the comment was to illustrate a contradiction you presented. In the
Hector Guevara thread, you said;

This case will ultimately decide who will own several translators.

But then you told CW that a court can't force a change in ownership and that he was gravely misinformed.

So which is it? With what CW presented (now retracted), I believe he has a path to regain ownership. (Of course, none of us are lawyers ;))

Guess you never have seen an involuntary xfer of control...or read a legal sale document filed with the FCC.
Oh well.....

I'm familiar with Fcc rules concerning involuntary transfer. We've had plenty of involuntary transfers attempted at KPFT between the local station board and Pacifica. Continuous wave, your problem here is that involuntary transfers can only be done when there is a death or disability. That's the FCC rule. 47 CFR § 73.3541 - Application for involuntary assignment of license or transfer of control.

Don't misunderstand me here. I'm not trying to jinx you or anyting. I hope you get paid one way or another. Just ask yourself if you really want it back. The station, where it's located. Is not worth much of anything. Broadcasters in rural areas like that all over the country are surrendering AM licenses. Another member recently pointed out that AM is dead. .

I still don't think you're going to be able to get the license back unless Carlos gives it to you. But the land the station sits on is worth $72,000. You can foreclose for non-payment and get your land.

Very well said.

If I were CW, I'd work with the Lopez family to get the payments back on track. The license has lost a lot of value and the land the facilities use seems to be the only asset worth salvaging at this point.

I understand that owning and operating a station has been a retirement goal for a lot of radio vets. While that may have been a great goal in the 90s, I'm not too sure it is feasible anymore today. AM Radio has reached an expiration date. It is now spoiling.

Meanwhile, a certain Spanish Christian LPFM in my area has been on the wrong frequency (5 whole numbers up the dial) the past 2 days...

But not like anyone cares. Haha

Speaking of Carlos Lopez, K222CX is still blasting away 250W of dead air, too. Can see the stick they're on from my office, and it's the only FM signal that comes into the building... shame it's dead air, could be put to good use.

You can’t get 89.3, 90.1, 91.7, or 106.9 in your office?

Who? Where?

KCGG-LP Radio Aliento in Kansas City. On 105.7 not what it's supposed to be on which is 100.7. Been like that since Monday morning. The MO board isn't very active so I stopped updating the thread, but it did this back in August for a couple days too. https://www.radiodiscussions.com/threads/kcgg-lp-now-on-105-7.739555/#post-6431945
They also have 1030 AM, and 1410 AM/92.7 FM. Those full power AMs and FM translator are on the correct channels. No idea what's up with KCGG-LP.

Lopez must being doing well, he's buying more stations... this time of an AM in Laredo for 25k.

Two things;

1.) CW, this probably means he has the means to get the payments back on track. I'm not sure what the details of the contract are, but I do hope you get your money instead of going through the hassle of "repo-ing".

2.) 25k for a border station that covers 220k+ (almost 800k if you count both sides of the border). The value of AM is pennies on the dollar! Outside of advertising a church, I just don't see the value in owning an AM station anymore.

How do you buy a station for 25k.. Nice!
