1180 off the air

If you check the website of "The Baddest Man on the Radio," it says he is off the air due to "legal" issues. But he says he'll be back at 9am tomorrow.

In the interim, his important show is stream-only on the website. So, if you need your Thaddeus fix, you're covered.

Apparently, Mr. Matthews doesn't understand that First Amendment issues require State Action. A widely misunderstood Amendment, sadly...

That is difficult to understand.
He seems so measured and thoughtful in his on-air statements.

I recall someone referring to Thad as a ticking bomb a while back.
It was only a matter of time until he exploded yet again.

I caught the last couple of minutes of Mr. Matthews show, live on the Internet.

Mr. Matthews claims he "doesn't know" when he'll be back on the air. Further, it appears litigation has begun. The Contract with Pollack, he says, has an arbitration clause. Thus, he says, the judge has ordered arbitration. Further, he says he filed a Lis pendens today, an action that prevents a litigant from encumbering property which is the subject of a lawsuit. Generally, those motions are routinely granted but the other party may call for a hearing to have it set aside. I would expect that to happen.

It all comes down to what is in the Contract. That would be interesting reading.

Im sure Thaddeus cant afford it but I suspect that Pollack Broadcasting can! In a sense, Thaddeus bit the Republican hand that fed him.

Thad was belly-aching yesterday about having to pay $700 for the work the lawyer has done for him so far.
Get used to "broadcasting" on Ustream, Thad.
 
Is there any chance that WPLX will go back to an adult standards format that it used to have? Maybe, the demographic for that format has died out now.

I know Bill Pollack is a huge Frank Sinatra fan. I wouldn't put it past him to get an adult standards format back on the station. Bill could sell WPLX again.

“Everything in the station is mine, except for the power from the transmitter. I’ve got my life savings tied up in this station and I’m not letting it go,” Matthews said. “My lease doesn’t expire until June 1, so my question is, ‘Why am I off the air?’ ”

Money is the reason, said William Pollack, who owns the transmitter for WPLX-AM 1180.

Specifically, more than $85,000 that Pollack said Matthews owes in back payments for time he leased to broadcast his program. After trying for months to work out a full payment schedule with Matthews, Pollack said he finally pulled the plug.
 
It sounds like a garden-variety contractual breach case. If, as Mr. Pollack alleges, Mr. Matthews is indeed in arrears to the tune of $85k, this should be easily resolved. The arbitrator should be able to sort out the financial data fairly easily; either Mr. Matthews is in compliance with payment or he is not. Further, I can imagine no event in which Pollack would renew the Contract once it expires at the end of May; when parties end up pointing fingers and name-calling, it's best they go their separate ways. This case will still likely be in litigation at that point.

In his defense, Mr. Matthews claims Pollack is "violating [his] First Amendment rights." Unless or until Pollack becomes a state actor, that is a legal impossibility. On his radio show recently, Mr. Matthews correctly stated that the FCC does not and should not take any action based upon his statements on-air. To do so WOULD run afoul of the First Amendment and the Communications Act of 1934. But neither law is applicable between individuals.

Business breach/tort cases are what I know best. Too bad I'm not working on it. Interesting stuff.
