Brenda Matthews vs. Clear Channel - go brenda!!!

If I understand this correctly...she can't be on the air.That wouldn't PREVENT her from V.T. in another state our outside the Orlando-Melbourne-Daytona Market.Also wouldn't prevent her from an OFF AIR POSITION in the Interim.

Just wondering outloud....Does this mean Brenda couldn't V.T. on XM or SIRIUS???
 
It seems very clear to me that Brenda should not be held to the non-compete; it was executed between her and another company altogether and unless there was a clause allowing for transferrability in the contract it became void when the staions sold.
It seems like CC is trying to reduce operating costs in advance of the sale.
It is so odd to me that corporate is killing what the sales people are selling...no more "live and Local," just VT from elsewhere....

I think the suits are under the impression that if they could fire everyone they could make some real money.

But those contracts carry over. Imagine all the companies that get bought & sold in this country having to re-do every contract they have when the sale is complete. There would be very few transactions. Besides, I'm sure if she had any sort of bonus structure in that same contract, she'd insist it be carried over.

Can't have it both ways, I'm afraid.

You're using facts not in evidence. The jury will disregard the statement.

CC puts NO bonuses in any non-compete. It's all about THEM, there is nothing in the contract looking out for the employee or promising anything. I know because I've signed their non-competes. I was told I wouldn't have a JOB if I didn't sign (and I have that in writing) and will assist Brenda in any way.

They will tell you, "don't worry, we won't hold you to your non-compete" but then when you find another job, they hold you and lie and say that they never said they wouldn't. You can't take them at their word, you must get it in writing.

It is a sad day when a man/woman's word is meaningless and they will lie to your face. It is deplorable!!
 
It truly sucks being out of work, we've all been there.
I feel for Brenda and anyone else who has been part of the downsizing.

Here are words I've lived by, "Hope for the best but plan for the worse."

Through the years, I to have signed the non-competes.
I knew what I was signing and planned for the worse.

I socked away enough money and was always prepared with an exit plan, just in case.
At some point, you're likely going to need it.

Same goes for the sub-prime mortgage mess, these people knew what they were signing.

My parents called it the rainy day fund. Someday it's going to rain hard!

Don't want to come across as cold hearted, it's just the way it is.

Contracts and agreements have many elements, such as annual pay increases, vacation time and bonus grid- AND, in almost every case (not just CC but most every broadcast company of size) includes a non-compete clause.

And in almost every case (except for a very few of the chosen elite talents) the no-competes are just a deplorable abuse of power to screw over people who have no leverage. I've never liked the way Clear Channel has metaphorically put their thumb on the scale and then gloated over their "well-earned" triumph. Karma's not fun and while I don't know what the outcome of the great LBO mess is going to be and if either side is going to be better for us in the trenches than the other, but I will say I'm glad that some of the big boys are having to sweat for a change. In this "stuff" is rolling up hill and people who have made lives miserable for a lot of good people are getting a taste of the kind of uncertainty they've been dishing out for a long time.

Plan for a rainy day??.....I'm certain she has, after more than a decade of service. She is no fool. This isn't about that. It's that she wants to work full time (in the only type of job she's ever done) and the place that doesn't want her anymore won't let her work elsewhere and wants to hold her to a contract that was signed over a decade ago! She was told verbally "not to worry about it." The "saving for a rainy day" is not relevent here. Let her work!!!!! My God, are we living in North Korea,Russia or China??? God bless America!!!
 
Sadly, radio is a nasty dirty business. Sounds like your old GM is a spiteful you know what who’s bought into her own Bull. Radio is filled with people like that. Big egos fore sure, but not much else. Radio is going through more change, so I'd expect things to get bad before things get better. The claws are out.. It's sad good loyal people are hurt.. and for what? Brenda fight your NC...They don't hold up in court..if your case goes before a jury you'll win! Because it looks like the big company against the little man just trying to make a living... You'll win! ..Radio is a bad business.. if you can I’d get out while you still have your sanity.

You nailed it. Not only will she win with her NC, she will then go back to sue CC for all of the costs she incurred fighting it.
It ain't over 'til the fat lady sings. I can't wait for that moment of truth. Unfortunately people have made radio a dirty business full of phony people with huge egos. What a shame. The very business that got them where they are, they are destroying. I am glad to now not be in the business.

BTW for those hard working radio sellers, we are very valuable in the marketplace. We are used to cold calling and 100% commission. There are many companies (check the BBB first though) that want us. They will pay us for our hard work in digging up new business and won't cap the amount of $$ you can make. There is a world outside of radio.

I have been selling radio for 18+ years, it's all I've ever known. For the sake of all, do not worry, there IS another way. The skills you have developed a sooo valuable in the marketplace!!

Go Brenda, fight on, you will win!!! No jury will side with CC or Linda/Sam or any of those rotten people in power for the moment.

As you’ve probably read here, I resigned my position at Magic 107.7 on 2/29, to take a full-time live airshift at a competing radio station, after being one of many downsized in 2008. Two weeks later on March 15th, my boyfriend Kenny and I were involved in a motorcycle accident in north Orange County. I was treated and released later on that evening, but Kenny was hospitalized for 3 ½ weeks - first in ORMC in ICU, the Trauma floor, then in the equally wonderful BIRC Rehab unit at Lucerne Hospital. He’s at home, now recuperating, and waiting for more rehabilitation, but we’re expecting nothing less than a 100% recovery. Lots of prayers were answered.

During the same period, too, I was working with Clear Channel to be released from my non-compete from 1997. In spite of everyone’s efforts, however, things just weren’t meant to be, the timing just didn’t work out, and at the moment, I’m not in the radio business. Yes, I still have a home studio, but I’m considering other avenues, possibly something in media relations here in town, so Kenny can continue with Rehab here in Orlando. With over 20 years in the business, I have a lot of transferable skills to take into other areas. I’m hoping to be back to work soon!

Thank you all for your interest and support, and e-mails. It’s time to move on. Speaking of which - did you see Ashlee Simpson on the Today Show this morning? How ‘bout that Britney Spears??? Who do you like for ‘Idol’ this season?

Brenda I was in radio for over 18 years and like you suffered through more than my share ups and downs. It’s all I knew and thought radio was it. But I’m out and happy to be so! Your time in radio has given you skills that are invaluable in the marketplace. Yes I miss radio sometimes and have fond memories. But in the world outside of radio, I found normal people are actually great. I don’t miss the big egos or nasty people I met along the way. Don’t miss living and dying by a book with numbers that makes no sense. Don’t miss the greedy evil empires.. there’s a few of them. Don’t miss focusing on 5000 task’s at once. I feel better and yes there is life after radio..

Anyway good luck...and hope you and your bf find good health.
 
I to after 30+ years I hung up the headphones, applied my skills in other areas and now I'm lovin' life.
Normal hours, normal people and double the pay. ;D

Best wishes to both of you.
When all is said and done, family and friends are all that matters.
