I don't know why, but KHYI is not encoding. Since they are located in a non-metro county, they would not qualify for a "free" encoder and would have to rent one. Although the rent is cheap, I suppose that they figured it was not worth it or they did not understand the process.

The policy, which is on the website, just speaks of in-market and out of market stations. Since a market is defined by counties, that would be the criteria used... licensed inside the MSA or not. The rental of the encoders is reatively inexpensive, so I don't understand this one.
