Entercom saw Khan thru the "Metco Gorilla" incident....which reflects worse on the company than a simple discharge of an unsucessful employee.

It doesn't matter that it's about what he "said" as oposed to his ratings. It's is WRKO's perogative to decide on programming. It's even their perogative to have different standards ofr different dayparts.. That's all legal and within their rights.

It will be interesting to "discover" what kind of dirt they have on Depeitro too. Do they have a folder full of memos warning him? Do they have previous reprimands? Had he been put on probabtion? Lastly, WRKO has his god-awful ratings to put forth.
All this will damage Depeitro's career. As of right now, he is being labeled "litigious"....and that will scare of any other potential employer.

For the record, John DePetro's lawyer, at last note, is the son of the former and extremely well respected former Massachusetts Attorney General, Frank Bellotti.
I don't think DePetro's lawyer therefore would lead him down a path that would not have some degree of success.
Right now, there are no lawsuits filed...so the lawyer isn't doing this on a "contingency fee".
Right now, he is no doubt billing Depeitro for "billable hours".
My guess is that Depeitro's lawyer(s) DON'T want this to go to court...because it will require a LOT of work....and a good chance that he (AND the lawyers) will come away with nothing.

I think Entercom can afford to wait out Depeitro...until he is out of money.
And for someone unemployed...Money is a big issue.
All this said...I am NOT a big fam of Julie Khan.
I just my opinion that he is grasping at straws....and I suppose, I can't blame him.....
