Yes he owns the website and the domain. He could get into trouble with CBS if he tried to present the website content as representative of what CBS thinks conflicts with its business. Just as the example I gave of the website that had Microsoft in the title. While the owner was only making a site to help windows owners, it conflicted with Microsoft and delineated the line of who he was and what Microsoft represented and he saw the domain taken from him. Basically the folks who arbitrate and decide who has the right to a website domain and intellectual rights when the challenge is made look at three conditions:
1, the domain name is identical or confusingly similar to a trademark or service mark in which the Complainant has rights; and
2. the respondent has no rights or legitimate interests in respect of the domain name; and
3. the domain name was registered and is being used in bad faith.
So in the case of the guy who has 1027wnew, if he used it in bad faith to what CBS does, as in a radio broadcast, or in a way that confused people to what CBS' trademark represents, he could loose the domain.
So look at what we have in the case of this website noted in this thread:
1. 1027wnew is not owned in any way as a trademark.
2. Since no one owns a trademark for 1027WNEW there is no conflict of interest
3. He does use a logo that is representative of CBS and what their brand represents.
Since he only has only one out of three, he has no fear.
BUT... I just looked and see that he hedged his bets and took down the WNEW logo and now only links to his myspace page. Guess he has been reading.
Case closed.
You may have registered a dozen websites but I have been involved with a dozen or so cases of litigation over web domains that my group purchased early on thinking we could buy famous names, but the organizations I have been involved with lost the domains due to the factors above.
