"Magic"? What will CC Say

WMAG DID have the Magic name registered/serivce marked. Whether they still have the rights, not sure. The new Majic might be able to capitalize in the Arbitron by using that name. Lots of people still around who call 99.5 Magic. Wouldn't it be amusing if CC swooped in and told them they couldn't do that...oops!
 
Yes, I remember when WMAG had the Magic name service marked. Even though they dropped the moniker, they could possibly still have the right to that name. Wow, that would be an interesting dilemma.
 
Do you REALLY think that they would have changed the name to Majic without thoroughly researching the name with ALL the appropriate avenues? I don't think so...I mean, they ARE in a market where the name was already used! Besides, being locally owned doesn't mean you're stupid! FYI for you research gooroos, magic was last used in the late 90s by WMAG. WMAG's loss, or drop in this case, could be someone elses gain. Personally, I think the use of majic was genius. They will probably benefit in both markets by using the name. Hey, at the very least they'll cause some listener confusion. I commend them for grabbing the bull by the horns and I'm looking forward to whatelse they'll bring to the table.
 
They will also not get full credit in the diaries for the term "magic". It will be split between them and WMAG.
 
If CC has a registered service mark in NC, they could force a name change, even though they haven't used it on the air in quite some time.

As for Arbitron credit, I doubt WMAG lists Magic as their slogan, and it could easily be challenged based on the Arbitron on-air useage rules.

I know too many radio station owners who don't research their ideas before using them. For example, WPTF runs a program on the weekend called Money Matters - a service mark that is registered to WSJS. Only reason they haven't been called on it is because no one from SJS has ever heard the use.

My next question is: does anyone think the new station will start streaming online? I can't get it here because of Sunny 93.9, but I am curious as to what it sounds like...

Streaming is supposed to be coming very soon.

I was told this (they would add streaming) by a very good source when they flipped to all 80's Hitz 94 in December 2001 and it never happened. ;) Still waiting for streaming! Of course I was living in Charlotte back then and could listen on the radio, but the signal wasn't that great in some places.

That's what I heard too, they would be streaming soon. Now, whether they end up doing it or not is another story.

WMJI's "Majic" identity and logo were previously under copyright, but it was done way back in the early 90's. The copyright lapsed earlier this year. Majic 94.1 is safe.

Due to WMJI's popularity around the turn of the century, CC did previously "franchaise" both the logo and name in different markets throughout the Midwest, though this is the farthest it's ever gone, IMHO. One was even in AM (!) All but two of these station are remaining, and one of them with the logo.

Oh, and WMJI - according to their website - has reverted their logo to the 1992 version. The one this new station is using (with the two floating rings and oval background) is from 1996.

I'm sure CC could give a rats A*ss about that at the moment, they have bigger fish to fry!
 
Companies that own trademarks generally protect them. If CC is preoccupied with other things, someone is not doing their job.
