But in the end, he will own outright even if it costs an arm and a leg.. and when you own outright, its not so bad paying all that money vs paying all that money just to lease.
Maintenance costs and electricity isn't cheap. Ask Bill Turner.
Plus, owning is easy to borrow against in the future.. you cant borrow against what you lease.
You're better off getting a mortgage loan on your home than you are from a license valued at 125k (and losing value every year).
 
Are you aware that HD sub channels in Houston are currently renting at rates between 5 and $7,000 a month?
But you don't pay for maintenance, electricity, or other fees incurred from managing a full time, 100kw FM station.
On top of that the HD primary channels make the translator cover the music licensing fees for the HD, which is very expensive.
You're supposed to be paying your royalties either way. Not doing so could result in expensive lawsuits and headaches for the license holder.

Are you saying the translators you work for aren't paying royalties?

That STA can be renewed repeatedly for years on end while a construction permit is applied for and then let sit idle and then reapplied for again a few years later.

I'm not saying that I have personal knowledge of what Rehan is or isn't going to do. I just been in this industry long enough to know how the game is played.
No offense, but the game you're paying is in the translator business (which can get shady AF with some operators).
 
that is the most ridiculous idea i have ever read on here.. if i remember correctly you sold him a station that was off the air.. so it really falls on you.. you gave him a broken station that had very little chance of coming back on the air without a massive investment that i am sure boy carlos had no idea.
The station was off because of a minor issue. An engineer, Jim Stanford, was brought in to fix it
Instead, he proceeded to totally redo the phasor and array, lying about his work and running up a bill of 80000, 90% was over charges because he would leave the site around lunch, pickup his wife at the hotel, and spend the rest of the day at movies, dinner, etc. The transmitter only needed a software reload. The array needed a little tweaking and that was it.
When the license final was granted by the FCC, the station was fully ready and complete. Any issues that happened after that date is not my concern.

You have almost no chance of getting it back. When a station is being sold and there is money owed, you LMA it until paid. Once a sale is consumated and the transfer done, the FCC considers it a done deal and will not get involved in any civil issues.
Check KZWA....the battle over its license ended with an involuntary xfer of control. The contract signed says I have the right when he is in default to take it all back land and radio station. It can and has happened in the past, 106.5 Houstonis another example when the Bakers, who started KRBE, took control of 106.5.

Is Entravision having financial problems? I remember long ago they sold their cluster in DFW. Surprised they left houston, I would expect they would have tried to get an FM here in Houston.
Entravision files public financials and they are doing very well, and just expanded into the international content arena with a buyout of the Cisneros / Venevision division in Miami.
How well do El Genio Lucas and Piolin do now in days?

Not likely. They are focused on new media expansion. In fact, they just gave up the LMA for three TV operations in Florida, returning the administration to Univision. In radio, they seem to only like markets where they can own radio and TV together.
 
Perhaps LA and Sacramento are the exceptions?
Yes, because they went in there before deciding that the synergy of radio and TV was better than the ownership of stand-alone radio operations in the era of consolidation.

Let me ask you this; wouldn't it be better to work with him to get the payments back on track instead of taking the station back? The value of AM radio has really nosedived. You got as much for that Beaumont station as Entravision got for KGOL.

Granted, KGOL came without the site property and the headache of having to find a new site.
 
I've given him plenty of latitude...my concern is the license...if it's lost by his (non)actions, he walks and I'm stuck with a radio station with no license...how much would that be worth?? My sale included the 8acres...he's behind on it too..and the contract he legally signed has a $250 /month late fee for the station and 10% late fee on land payments. I told him no more. I'm enforcing the contract HE signed....cough up the money or else...plus the fact he got hit by the FCC on 2 late xlator renewals...he filed the renewal for 1300 late! I bet the FCC will really hit him hard on this. The translators are getting renewed if he pays the $1500 fine but when 1300 comes up, that's strike three with the FCC..they WONT be so generous to him on this...
So I have a vested interest in this,hell, it's MY MONEY!! I'm tired of the games...the contract WILL BE followed....or else..

I guess I don't understand the structure of the sale. Did you finance Lopez' purchase? He has enough assets around the state to use as collateral.

Either way, I hope you get your money. That license can't be worth more than the 8 acres it sits on.

He overpaid for that station .. not worth half of what he paid . I would be willing to put some money that you can’t get it back .. anyone care to put some money on a bet . The station had been off the air for a while . López probably realized he won’t be reaching anywhere near what he expected .

FCC law is clear. You can't take a license back like a bank repos a car or forecloses on a house. The only way the FCC will transfer it back is if Lopez files to transfer. Contracts and agreements are for enforcement in civil court, which can award damages. But a court cannot transfer a license.

Fcc won’t even entertain the idea.. somethings they just don’t get involved with and this is a civil mater. Take him to the small claims court
