Verizon FIOS is carrying WLVT 39 in South Jersey. I called Ch.39 many years ago - and asked about possible Comcast carriage in Southern NJ. The engineers responded it's out of their must-carry area. Prior, 39 couldn't assert carriage rights because of WHYY12 and NJN, being more local in Southern NJ and Delaware. WLVT could only claim the South Eastern PA portion of the Philadelphia DMA, some areas of Central NW NJ where usually the cable operator didn't play hardball, and some towns in between Allentown and Scranton, but within Wilkes Barre/Scranton's DMA, anywhere within 50 miles approximately.
[BTW, it lost DirecTV carriage for a while as well, and remains unavailable on Dish Network. Dish Network opposed carrying the station, as Dish finds it duplicative to WHYY, and Dish already carried 3 NCE (non commercial educational) stations - WHYY, NJN and WYBE.]
As for FIOS, it appears carriage of WLVT in Southern NJ is voluntary, just like the MSG/FSNY they provide. If I were running FIOS, I'd get WMGM 40 and WNET 13 on the dial as well, to push more of an alternative from Comcast's lineup. WNET 13 is receivable over the air, with a rooftop directional, in areas like Burlington County. Of course, WHYY wouldn't like it much, but I don't know if they could prevent it. Another one, though not very hugely popular would be WBPH 60 (Ind.). I believe they offer programs from FamilyNet, and they carry Lehigh sports.
