Power 106 being sued by photo agency

Something the Meruelo lawyers should have been well aware of, photo agencies are notoriously litigious and will absolute go after media companies that post copyrighted photos without license!
 
post a picture of a Snickers bar you didn't take and put it on your station website and see how long before the cease and desist letter shows up.

They have Bots that do nothing but look for copyrighted photos on websites and nail the stations to the cross for not paying a licensing fee

 
This demonstrates exactly why stations, especially larger companies who these lawyers believe have deeper pockets, run a risk when they have a jock or an intern, or the local cluster manager's kid, running their websites and social media, rather than hiring a person or agency who's familiar with laws and regulations governing the things they post. These attorneys are just opportunists for the most part and they don't care if your station intentionally cherry picked one of their "client's" copy-written photos, or if some low-level intern rather innocently posted a photo - they want their $$.

Most of these lawsuits could've been avoided had the station simply posted the required text with the photo, giving credit and/or mentioning where they got the photo from. Keep in mind that, even the moderators of Radio Discussions must think about the type of content users of this website post and how it's done. Especially if a user posts snippets from a news story or certain other sources. Credit must be given/links should be provided and only a certain length of the referenced article can be posted here.

True too and in the case of radio I don't know for sure how contracts are handled for the outlets to use photos for their sites. But I do know on the TV side that is pretty common for photo agencies and news outlets to have agreements to use video from stringer services for TV and website.

It's not just the lawyers, all the employees need to be aware too. The bigger radio groups make staffers take mandatory training on what is and is not allowed to be used online for exactly this reason.
