Question: Re daytime AM still has to protect clear channel at night.

Well, she lives pretty far from the station she inherited.

WCPS is 1000 watts, days only, licensed to Tarboro NC, about 65 miles east of Raleigh. Urban Gospel and Urban Oldies, according to Wikipedia. Translator at 96.3 FM.

LMA to the rescue.

The transfer of control of the license company shows the estate's executor, Theresa Walker, to have that responsibility. Her contact information, from the FCC filing, is:
Theresa A. Walker, Executor
3418 Vick Road
Nashville, NC 27856
+1 (252) 567-6829 [email protected]
The question that I have is does the FCC is even aware about this situation?

They know about the ownership and LMA. Estates get some "slack". The FCC usually doesn't "look" for violations. Unless they get multiple complaints from the public or a complaint from another broadcaster they are not going to shut them down or put someone in jail.

I still asked: have you contacted the station?

I've caught WCPS evenings in central MD, didn't know they were at it all night. They have an FM translator so doubt it's intentional.
Many things are blame for this incompant

alot of things are to blame for this Incompetent management.

This is very small station, likely struggling for life. Mos6et managers came up through sales and are not engineers. So if something breaks, the contract engineer is the one to call out-

Again, there is no proof that management is "incompetent". Most managers I have known should not be allowed within ten feet of a transmitter.

It's questionable whether this is a regular occurrence. I just checked local SDRs and I couldn't hear it. Granted they're in Raleigh but I'd imagine some signal would make it at night if they were on. All I heard was WJR

Keep in mind that skywave is not always reliable and therefore not a good indicator of whether WCPS-AM is on or off of the air at night. To be absolutely sure, you would need to be in the groundwave coverage of the station's nighttime signal.

That said, if the original poster is so bothered by this, he/she should contact the estate directly by the mailing address generously provided by @K.M. Richards and see what kind of response is received *before complaining to the FCC.

That's true. I was thinking more of possible terrain issues locally I wasn't aware of. And the fact the SDRs are slightly outside it's coverage area.

I just looked over the website, and Mrs.Walker lost her husband a year ago (Rev. Thomas L. Walker) who was the owner/CEO. Her position at the station was Office Manager, Of course she became CEO after his death. She may be the only one taking care of things, amd may lack the experience needed, particularly technical. The streaming audio quality is highly distorted, BTW.

From the website, the transfer of license was recently filed on February 2.

PUBLIC ANNOUNCEMENT

On February 2, 2026, Trey and Associates, LLC, the
Licensee of WCPS (AM), 760 KHz, Tarboro, North Carolina and
W242DG (FX), 96.3 MHz, Tarboro, North Carolina filed an
Application with the Federal Communications Commission for
Transfer of Licenses. Members of the public wishing to view
this Application or obtain information about how to file
comments and petitions on the Application can visit
www.publicfiles.fcc.gov and search in the WCPS public file

The transfer to the estate was fairly recent, and my feeling is that this will be put up for sale. I think Mrs. Walker needs help more than anything. Please reach out to her first with a kind email explaining what's happening to avoid issues with the FCC. If not resolved than complain to the FCC. Good chance WJR might.

Looked at the recent history for WCPS - the owner passed away and it is being managed by an executor. I suspect the equipment / timer failure theory is correct and they aren't aware of it. A phone call or email to the station would be the first step.
Correct. Always do the professional thing and contact the station first. 90% of the time they don't even realize whats happening.
