Stephen Yates back in jail!

I heard a good quote that I think applies here...

"Prison should be a place where we keep people we're afraid of, not people we're mad at."
 
I don't know about you, but I'm very afraid of someone who is a known alcoholic and occasional drug user, who ignores the law, gets arrested and convicted several times, gets probation but ignores or forgets the terms HE agreed to so he could stay of prison. Feel free to jump in any time.

So hell yes I'm afraid for my safety and my family's safety knowing that people like Yates are driving the same roads I drive. I'm all for whatever it takes to get him to sober up, dry out and come to his senses. It's sad and tragic for him and his family and they are all in my prayers -- but I fear it's going to take a few years in jail to do that.

Full disclosure: several members of my mother's family suffered crippling injuries and permanent brain damage in accidents that were caused by drunk drivers like Yates. At least two members of my church have had children killed by drunk drivers.
 
That me help with the drinking problem , but the attitude problem is another thing . Hope this brings him down a notch from thinking he can do whatever he wants to people and get away with it .

been gone a couple of days. what's new with the yates situation? i suppose "we don't know, what we don't
know." but, it all begins monday, yes?

as they say district judges sit at the right hand of god, so anything is possible. i hear this judge is a real tough
one.

FilioScotia, your fears may be realized, but i think not. i am sure his attorney(s) will make a good argument for leniency! it will be difficult for her to send him for an extended jail stay, since he was only driving
without the vehicle being properly equiped as was a condition of his probabtion. had he been caught actually driving under the influence, then that would be a whole 'nother story.

also, they will argue that he is only parent
in the household, as well as the breadwinner. under these circumstances it will be tough for judge to send him away for any lengthy time.
but, there could easily be additional information, that the DA has that could be a real
game changer. also, i have seen nothing on the actual content of the warrant other than that single charge. could
there be addtional charges, as well?

some people think that "miracles happen everyday, never give up on anybody".
maybe they do. but some people stay a**holes their whole life. who has the strength to endure a jerk everyday, hoping for a miracle that may never happen? even if it does happen, do we have to wait years and years and years? nobody has to be a saint.

my philosophy: after a time I give up on jerks. If they change that’s cool, they’ll find my door open. If they don’t I won’t give a s**t as long as they stay far away from me.
 
I am sure he will use the "single "parent' arguement, bread winner , forgot to put the tester in has been busy whatever will work for him . He is not above it . Even though he has had the car I am told for a while and knew the terms of his probation, by heart. Has he taken a drug test ? Alcohol consumption test ? Guess we will all know the out come Monday .

You are right for most it takes a life time some never. I don't think this lepoard will change his spots , he has been this way too long. I wish nothing but the best for his children , I know they have family support and are loved be many . They will rise above this . And yes there may be something else the DA has up their sleeves .... there are a few things out there but no ones talking .
As long as good people do nothing bad conduct has free reign to rule . I was always told if you dance to the music , you gotta pay the piper . Mr. Yates' dance card is full.
 
yes sir, i was always told the same. someone in an earlier post asked who was running the stations. but, the bigger question is the
structure of ownership since his wife's passing. if ownership was transferred, after the original conviction, and i am sure it was, now that she has
passed, who holds ownership/control? i would guess that has not been settled either. since i am not well informed in broadcasting rules i could only speculate. anyway, i am sure he needs to be seeing to matters such as those, rather than what he is currently expending his resources on. i would guess he is dangerouly close to losing control of his fiefdom! which might not be all bad, in that might finally allow him to get control of those things that really matter most in life. sometimes i am a cynical old sob, but wouldn't that be ironic. karma..........
 
I don't think the FCC had a clue about his conviction redhotnine ,or they would have stopped the LMA and he wouldn't have been blatantly
trying to steal ... err.... buy two other radio stations as he bragged he was doing blatantly. See his dimize is with his ego . Thats why if he gets off, his ego will soar once more .
Heard he was in court the day before his arrest trying to steal ..err... keep the owner of one radio station from taking it back because he was trying to (buy) it out from under him. Come Monday we will know what there is to know .

According to this morning's Lufkin Daily News, the judge in Livingston scheduled a formal probation revocation hearing for May 16th. She also denied Yates' request for bond pending the outcome of the hearing. This means Yates will remain in the Polk County Jail at least another three weeks.

The judge could re-instate his probation, which means he would go free, but would only stay free if he stays out of trouble. Sound familiar?

The LDN says Yates was convicted of DWI in 2007 and sentenced to 10 years. Even though it was his THIRD conviction, he was given 10 years probation, which he violated almost immediately. In June 2007 he failed a mandatory drug screening and was sentenced to 90 days in rehab after spending 12 days in jail.

His 10 years probation remained in place, but he was ordered to install a breathalyzer controlled interlock on his car, which he did, and he was forbidden to drive a car that doesn't have the interlock.

That's what got him in his current trouble. Yates was arrested a week and a half ago in Lufkin, after an Angelina County Probation officer saw him driving a vehicle without the interlock. And we can assume that wasn't just a one time thing. He just got caught this time.

With his demonstrated inability to live by the same laws everybody else has to follow, and his history of ignoring the terms of probation, does anybody really believe the judge will just slap him on the wrist and let him go free on probation again?

I think the judge has no choice but to revoke his probation and send him to prison. It could be for the full ten years he was originally sentenced to in 2007. Judges can do that to repeat offenders.

That's going to be a huge cross for his family to bear. His daughters are in high school and my prayers go out to all of them. Sooner or later Stephen must face up to the pain and suffering he's causing for his family, and, sad to say, I fear it's going to take some hard time behind the high gray walls of a prison to do that.

I have no idea what will happen to his radio station holdings.
 
I am sure a trusty appointed by the courts will be in charge . His children probably have a trust from their mother's interest in the stations , so if kept it would probably go in a trust for them or sold and the money put in trust for them , except for the 2 stations that don't belong to him . Their fate has yet to be determined . The day before Mr. Yates was arrested he was in court trying to take away their ownership by strong arming the owner. He has no rights to them , he didn't care who it hurt , he just wanted them and he was going to take them regardless. That is a known fact and is part of a public file . His children great family support with their mother's family so to use the kids in court is just another low and contemptible act that proves it's all about him and what he wants not anyone else . They will be just fine. Do the time Mr. Yates it may make you a better man in the end.

good analysis. you may very well be correct. this scenario gives the courts problems, but that's what they
do, deal with problems. yates could very well be doomed, as anyone plagued with his particular type of narcissism in their DNA and that will surface in this hearing. You take yourself wherever you go. Few, I think, change. Unless they get a DNA transplant.

how could the FCC not have a clue. one would think that whomever yates was in court with regarding control of those two stations would have made very sure they were fully informed. and now this?

According to court documents, this was his second probation violation. The first happened only months after being placed on probation."

Bahahahahaha! Holy Jesus H. Werewolf! Ladies and Gentlemen... I present to you... the Good Old Boy System.

What an absolute slap in the face to the community AND to the 1000's of families who have had a loved one killed by a drunk driver. This man doesn't deserve to see freedom! He deserves nothing more then metal bars and a bed. There are way to many people serving time in actual PRISON... on lesser charges.
 
I'm as baffled as anybody as to why this judge gave Yates another chance, but it's not because of a real or imagined "good old boy" system. It appears Yates had the good luck of coming before a soft hearted judge, who apparently took pity on him because his wife died a few months ago, leaving him the single parent of two teenage girls.

So, the judge let him walk again, but it's worth noting that she warned him that it's his last chance to keep himself out of prison. He's under Zero Tolerance from here on out. One more probation violation screw up and he's heading for the big house.

He has to wear an alcohol monitoring device at all times, and with his driver's license suspended, he can't be seen driving a car - any car - with or without a Breathalyzer - till 2017, when his ten years probation ends.

Even though he was convicted in Polk County, his probation is monitored by the Angelina County Probation Department in Lufkin, and you can bet those people are watching every move he makes - every day. He would be wise to hire a driver to take him wherever he needs to go. Just one screw up and it's all over.

Having said all that, I really do wish Stephen well and I hope and pray that he will make it through this long dark night of his life and come out of it a better man.
