Tower Registration Nightmare

Client station discovered their tower wasn't where they thought. 7 seconds off.

Registered in 1997 but owners didn't tranfer the registration (noted as wrong place.)

FCC claims it will not authorize ANY operation of registration is not correct. FAA indicates new Air Haz determination is needed.

Tower transfers owners 3 times and most recently to a new owner. Registration still 7 seconds off.

Can the station operate legally at a site with an incorrect registration? has theis scenario played out before?
 
Did a 302 for an AM station once that was 1 second off in each direction, had to do new FAA filing.

They better call FCC attorney on this one before they do anything. With an AM may have the effect of "racheting" down the power; with an FM may get even messier. You may also need a consulting firm.

Double-check the coordinates. Best to get a paper topographic map & locate the tower's coordinates using that, before you rely on GPS or internet coordinates. Have had a kind of funny story involving a GPS--I did an LPFM app. directly south of an existing AM tower. After CP was granted the minister who wanted the station became convinced that I had used the AM tower's coordinates because he couldn't convert the GPS digital readout to degrees-minutes-seconds correctly.
