WCRS-LP/WCRX-LP timeshare

A lot of the episodes have themes, including the three older ones most recently uploaded to my web page (coded YTS-21, 22, and 23), which represented the first half of a six-show "Name That Band" challenge. The much-more-recent episode #170 includes some good BPs (as opposed to the evil and vile one) before it evolves into a kiss-fest (which is much different from a Kiss-fest), #171's theme is the letter U and features eight bands that begin with it, and tonight's episode (#172) largely consists of a Used Kids Corner, which is music from recent acquisitions of mine from Used Kids Records, which has been underwriting "Yesterday's Top Secrets" since March of last year.
All of these shows are now available for instant downloading or playing at the web page cited in my inserted quote above (thanks, Dave -- and thanks also to the Dispatch for yet another listing in today's "Today's Highlights").

Simply Living has rejected the latest offer of discussion point to Bexley, actually they had did that before they received the correspondence from Bexley, and has since re-affirmed their intent to proceed to transfer the station to another party.

To my way of thinking, many of the exact same issues are being questioned, as were addressed in the previous filing on the captured hours, as such, I would probably expect a similar response from the Commission.

My suspicion is that Bexley will respond to the transfer filings, and simply wait for the process to run it's course, as they did last time.

We have before us a Petition for Reconsideration (“Petition”) filed on June 1, 2010, by Simply
Living, licensee of low-power FM (“LPFM”) Station WCRS-LP, Columbus, Ohio.1 Simply Living
requests reconsideration of the May 3, 2010, letter reissuing Simply Living’s license for WCRS-LP with hours of operation from 3:00 p.m.–8:00 p.m. daily.2 In the Petition, Simply Living also requests a waiver of the requirement in Section 73.872(c)(2) and (3) of the Commission’s Rules (the “Rules”)3 that any modification to a time-share agreement requires the written approval of all parties to the agreement (“Waiver Request”). Finally, it asks that the Commission conduct an arbitration to resolve the disagreements between Bexley and Simply Living regarding the hours of operation for WCRS-LP and WCRX-LP.

For the reasons set forth below, we deny the Petition and Waiver Request.

it's not settled, although the commission is saying rather sternly, if you don't fix soon, we will. The re-opening of the filing window has always been an FCC option, I guess that there are not a whole lot of folks stupid or arrogant enough to let it get to that option. A third, forth, or fifth applicant might choose to do something that both groups really dislike, and that process may well take years to complete, assuming more than one new applicant might apply.

Simply Living has said they want totransfer out of the license... They wish to assign it to TNN.

Although, I cant be absolutely sure, it is hard to determine if SL wants to settle the time share before the decision to transfer the station is made, although I would think that would be in their favor to do so

I do expect one last round of filings and documents, I thought it interesting that all sides seem to think that they are "at" advantage here. I think the "law" is on Bexley's side, the "karma" is on Simply Livings, and "emotion" is on TNN's, so it really depends on what you believe in most!

So far, the score with the FCC seems to be Bexley 2, Simply Living, 0, and two strikes, two balls, with nobody on base.

Depends if they can hit at Home Run, or a foul, cause whatever happens, it going to be right down the foul line.

In this game though, you can argue with the ump!
 
Yeah, it's the right decision, good for the FCC. "Yesterday's Top Secrets" is going strong and will continue to go strong, as will all of the other fantastic programming on WCRS. My 201st episode will air and stream this Thursday night.

It's certainly an interesting decision. I think by the overall tone, the FCC would like to see this dispute go away. I don't think the decision was totally unexpected, and it will be interesting to see what the reaction from TNN will be, as far as working out agreements with Bexley.

From my standpoint, I think the Media Bureau really doesn't like outsiders questioning their processes on issuing licenses, and I think Bexley was not as firm as they should have been in their responses to the Commission, although the option for filing a reconsideration is still an option. If a request for reconsideration is done, I think it will ask some difficult questions, that nobody wants to see.

Not coming to agreements on the disputed issues will only hurt both groups, and prolong the pain and frustrations at the commission level. Based on recent conversations, I tend to think that most of the TNN management is more willing to work with Bexley moving forward, as they have indicated they have more interest in the future, rather than the past.

We will see...

Jakej, I heard your show last week where you said WCRS-LP was the only radio station in town to take on "Yesterday's Top Secrets" after
ten years of trying. Will your show still be available under the new owners, TNN? The news owners are planning to taking on more locally produced
programming so will this include your contribution to the station?

I understand that they need to get some licensing and insurance in place, and they have also sent some information to the city regarding the current status. They have yet to file for consummation of the transfer, which they can do at any time. There are some minor chats going on between TNN and Bexley, although nothing official can happen till they file the consummation.

Bexley decided not to file for Reconsideration. It's not that Bexley feels that the decision the FCC rendered was correct, but it was decided that the delay that the reconsideration would cause have been time consuming, and that the current best interest of all would be to get the station on the air full time, and working out potential disputes later. I know that in some of the unofficial chats some of the key TNN people feel the same, so lets hope sanity reigns.

Well, I suppose the decision is theirs, but no one has notified me of any impending doom for "Secrets" so I'm still cranking 'em out on a two-a-week basis. Some of the people most heavily involved with WCRS are on the board of The Neighborhood Network, and I consider those people to be friends of mine, so I trust that everything will be fine. Of course, what also helps my chances of survival is the fact that since March of 2009, "Yesterday's Top Secrets" has enjoyed continuous underwriting support from Used Kids Records, and while there's no guarantee as to how much longer this support will continue, it will definitely come to a stop if the show comes to a stop!
Our 209th episode will debut tomorrow night at 7:00, as we begin our third week with the Searchers and Squeeze as our featured artists. Thanks for listening last Friday, Mr. Bigley, and I hope that you enjoyed all of the music that you heard! As usual, the show was a blast for me to put together -- for you folks who may not know, we went with a people-as-inanimate-objects theme, with songtitles such as "If You Were A Rock 'N' Roll Record", "I Never Asked To Be Your Mountain", "Ballad Of Ole' Betsy", "I'll Be Your Mirror", and "Say Goodbye To The Little Girl Tree" being included, from Freddy Cannon, Tim Buckley, the Beach Boys, the Velvet Underground, and Nick Cave and the Bad Seeds respectively.
 
Had to say WCRS was getting hammered by the WINF rogue signal. Also fighting with it on the translator! Might want to talk to the heads of WCRS and have them say something to the FCC! This is getting out of hand!
