I, too, am surprised this case hasn't settled, but...
Remember, it takes two parties to cobble a settlement. It may well be that the Plaintiff thinks that he has such a great case, such bad facts against the Defendant, that a jury will give them a bigger bucket of money than Entercom offered prior to trial (assuming Entercom made an offer).
But, Entercom's "foreseeability" argument is going to be a tough sell. Heck, they have discussion from the event in which the principles discussed the Chico death. Wow. Those are really bad facts.
