No such rule...the only towers that require fencing are AM towers...the fence must be a certain distance from the tower depending on the AM station's power.
I'm not sure you're correct. But I've never been an engineer either. I'm going to contact the engineering division of the FCC to pose this question.

I appreciate that...If I am incorrect, I need to know about it.

My understanding is that there are only liability issues from not fencing an FM tower. The reason for an AM tower being fenced is that there is RF radiation from the tower at ground level. FM radiation is within a certain distance of the antenna. I do know this...on top of Mt Washington,NH, there's an FM station running just shy of 50KW from a very short tower. No fence around it & tourists are free to walk up to the tower
 
47 CFR Sec 73.49
Antenna towers having radio frequency potential at the base (series fed, folded unipole, and insulated base antennas) must be enclosed within effective locked fences or other enclosures. Ready access must be provided to each antenna tower base for meter reading and maintenance purposes at all times. However, individual tower fences need not be installed if the towers are contained within a protective property fence.

RF potential is not found at the base of even the shortest FM tower, therefore no fence is required. (If I'm not mistaken, Mt. Washington's towers are in the range of 50 ft AGL)
