Don't fool yourself, the industry may be de-regulated but they still pick and choose and if they get numerous complaints they WILL investigate.
Considering the FCC doesn't do ANYTHING to pirates, I don't think thats the case.
There aren't many operators in Sactown that would run their FM with overmodulation. (Overmodulation on FM causes distortion.)
I can't imagine any operator who would do this. (Are we talking a college station?)
