Notification of License Cancellation
Dear Licensee:
This letter is to inform you that the license of Station KVGK-LP, Las Vegas, Nevada (Station), licensed to Las Vegas Public Radio Inc. (LVPR), has expired pursuant to section 312(g) of the Communications Act of 1934, as amended (Act). On November 7, 2022, LVPR filed a request for Special Temporary Authority (STA) to remain silent for the Station, stating that the licensee had intended to surrender its license, but then reconsidered this and ceased Station operation on September 4, 2022, while it moved to a new transmitter site. We granted that request, noting that the period of silence from October 4, 2022 through November 7, 2022, was without authority because the request was untimely. On May 5, 2023, LVPR requested an extension of silent STA for financial reasons. We granted that request, noting that the broadcast license for the Station would automatically expire as a matter of law if broadcast operations did not resume by 12:01 a.m., September 5, 2023. On August 21, 2023, LVPR filed a second extension of silent STA request,7 including 26 attachments, indicating that the Station would not resume operation by 12:01 a.m. on September5, 2023. In addition, we have not received a notice of resumption from LVPR stating that the Station resumed operation by that time and date.
Additional STAs were filed on August 24, 2023 (Application File No.0000219863),and August 31, 2023 (Application File No.0000220084); they have been consolidated into one request.
In addition, we have not received a notice of resumption from LVPR stating that the Station resumed operation by that time and date. The Commission’s discretion under section 312(g) is severely limited. The Commission has exercised its authority to reinstate an expired license to “promote equity and fairness” only where the station failed to provide service for 12 consecutive months due to compelling reasons beyond the licensee's control.10 Conversely, the Commission has declined to reinstate licenses where the failure to transmit a broadcast signal was due to the licensee's own actions, finances, and/or business judgments.11 Based on our review of LVPR’s filings, we find that LVPR’s failure to resume operation at the Station is based on LVPR’s unfounded and unreasonable belief that it could convert the Station to commercial operation. LVPR’s futile effort to pursue such a plan is a business decision within the licensee’s control, and therefore no reason in fairness and equity exists to extend the Station’s license beyond the 12-month period specified in section 312(g). We have therefore concluded that the Station failed to operate with authorized facilities for more than 12 months, and that its license has expired.
Therefore, the Commission's public and internal databases HAVE BEEN MODIFIED to indicate that the broadcast license for the referenced station is EXPIRED, that the station's license is CANCELLED as a matter of law, and that the station's call sign is DELETED.
